"today in the bay's" arturo santiago is live in san jose with what the city is planning to do about it and when they're planning to do it. arturo, good morning. >> reporter: the situation out here has not improved in the last few weeks. the population of the tent city in fact has swelled to more than 100 people and the city of san jose now has plans to move the encampment out the first week in march. now the site is located along spring street between taylor and heading streets. it's in a large grassy field near the guadalupe river park. the tents are spread out and clustered around trees on the land. the tent city started to grow back in january after state lands along the guadalupe river were cleaned up by caltrans and that displaced the homeless camping in those areas. mayor chuck reed says the people are trespassing here and there are no sanitary facilities and city cannot have people living i

. investigators say they've been tracking him the last two months. oakland today became the first city in the country to issue city i.d. cards that double as debit cards. that groundbreaking municipal program launched today. the goal is to ensure that everyone in the city has a usable form of identification regardless of their immigration status. the i.d.s will serve as debit cards so people who usually only carry cash can now have a more secure way to keep their money. >> a huge way of giving access to people who are right now living in the shadows, this way they can feel safe representing themselves to the city authorities to access city authorities, the police, at the same time have financial services at very low cost and not feel that they have to live in cash the rest of their lives. >> oakland residents can preregister for the program as of today. critics worry the cards could be easily stolen and compromised. >>> okay. 49ers fans have been waiting for 18 years for this. so now the wait is less than 48 hours. an interesting twist in new orleans today. the opposing head coaches he

, about 250 cities across the state have banned pot dispensaries. at usf today the seven justices of the state's top court heard arguments from one of those cities, riverside, which banned them and was sued as a result. the justices appeared skeptical of the arguments made on behalf of the medical marijuana industry. >> we're only asking for a very simple ruling, exactly what the statute says. you can't ban -- >> i just think it lends itself to lots of different kinds of unanswered questions and further litigati litigation. >> reporter: the justices were less severe in their treatment of the one who pointed out there's nothing in the medical marijuana law prohibiting local government from enacting bans on pot clubs. >> the state and federal government and implement a safe distribution for the medical use of marijuana. that has not happened. >> reporter: a medical marijuana advocate who attended the hearing said it seemed clear to him local governments can only regulate the medical pot industry, not ban it altogether. >> we need regulations through prohibition. prohibition has not
